Terms of Service

1. Acceptance of Terms

By accessing or using the Trinchero Control Panel ("the Platform"), you agree to be bound by these Terms of Service. The Platform is operated by Nonfiction Agency ("we," "us," or "our") on behalf of Trinchero Family Estates. If you do not agree to these terms, do not use the Platform.

2. Description of Service

The Platform is a multi-brand marketing management tool that provides:

• Social media content creation, scheduling, and publishing
• Analytics aggregation across multiple social media platforms
• Community management (comments, direct messages)
• AI-assisted content generation
• Competitor tracking and analysis
• Editorial workflow and collaboration tools

3. Authorization and Access

Access to the Platform is limited to authorized users. You are responsible for maintaining the confidentiality of your account credentials. You must not share your login credentials or grant access to unauthorized individuals.

4. Connected Social Media Accounts

When you connect social media accounts to the Platform, you authorize us to:

• Access and display your account profile information and content
• Publish content to your accounts on your behalf
• Read and respond to comments and messages
• Retrieve engagement metrics and analytics data

You may revoke this authorization at any time by disconnecting the account from the Platform or by revoking access through the respective social media platform's settings.

5. Content Responsibility

You are solely responsible for all content created, uploaded, or published through the Platform. This includes content generated with AI assistance. You must ensure that all content complies with applicable laws, regulations, and the terms of service of each connected social media platform.

6. AI-Generated Content

The Platform uses third-party AI services to assist with content generation. AI-generated content is provided as a starting point and should be reviewed before publishing. We do not guarantee the accuracy, appropriateness, or originality of AI-generated content. You are responsible for reviewing and approving all content before it is published.

7. Data Deletion

You may request deletion of your data at any time by contacting us. Upon receiving a valid deletion request, we will remove your personal data and any associated content from the Platform within a reasonable timeframe. Data that has already been published to third-party social media platforms must be deleted separately through those platforms.

8. Prohibited Uses

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorized access to the Platform or its systems
• Interfere with or disrupt the Platform's operation
• Use the Platform to publish content that violates third-party rights
• Reverse-engineer, decompile, or otherwise attempt to extract the Platform's source code

9. Limitation of Liability

The Platform is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the Platform, including but not limited to: content published to social media accounts, loss of data, or service interruptions. Our total liability shall not exceed the amount paid for the Platform in the twelve months preceding the claim.

10. Third-Party Platform Terms

Your use of connected social media platforms is subject to their respective terms of service. We are not responsible for changes to third-party APIs, terms, or policies that may affect the Platform's functionality.

11. Modifications

We reserve the right to modify these Terms of Service at any time. Continued use of the Platform after changes constitutes acceptance of the updated terms.
